Apple & Their Lawyers
A few weeks back I wrote about S60Themes. A site dedicated to creating great themes for S60. Many of the initial themes were based on the UI of Mac OSX.
It’s seems as Apple’s lawyers have been busy since SJ announced the iPhone.
Apple’s lawyers have been sending out cease and decease letters to a number of theme designers, developers and bloggers who according to Apple have been encroaching on their territory. Anything remotely linked to Apple+Phone has been a target of these hard working lawyers.
I understand that Apple wants to protect their brand but this strikes me as silly.
These Apple wannabe themes for Symbian, Palm OS and even WinMo/PocketPC are for and by Apple fan boys. This is viral marketing. Fanatics (like myself) paying homage to SJ.
Hmm, I can’t help feeling slightly miffed at Apple.

It is very sad to hear of things like that. Always felt that Apple is just too proud and arrogant a company. No doubt they produces some very nice products but to throw their weight around like this is….
People are doing this just because they love their stuff so much, its not like they are making fun of the product, so what damage is it causing anyway?

Oh yes, I heard some report that they are sued by Cisco in the first place for using the name iphone. Ha! Look whos talking eh.

Aw man! That’s a sad thing to do…. nothing wrong in paying homage to an otherwise great product I think. In fact it may make Apple fanatics drool even more for the real deal

concurs with liew, apple should be proud that people loves their product even if their future product (iphone) is yet to be released.
as regards to iphone, the same is not owned by apple but rather owned by cisco. how come apple have the right to sue when in fact the same is not theirs.
as to the developer of themes, i guess that they should upload their themes on a place which country has no law that prohibits the creation of a look-a-like themes, or maybe outside US, in which the US courts has no jurisdiction to try and prosecute immitators.

Sorry guys, I have to respectfully disagree. All of the themes in question don’t just look like Apple’s products, they are using the actual graphic images, which is copyright infringement. Apple has to protect it’s IP rights, otherwise they won’t have a legal leg to stand on if and when a real competitor copies their icons, which has already happened.
While I agree that to some, it’s just a way to promote the brand they like, for others, it may be enough for them to not buy an Apple product, because they can get the same look on the phone they already have. If you want the Apple look and feel, then buy the Apple product when it comes out.

As andy pointed out, it is in the best interest of any company to defend its trademarks, failure toi do so can be cited as presience when a real suite needs to be filed. Read up on copy right and you’ll see.

Apple should consider it an honor if an s60, Windows Mobile, or Palm user defaced their superior product with their featureless UI. I’ve downloaded the themes and I may just use them as an insult.

I think that people are confusing two things here; copyright and trademark. Latter you have to defend to keep it, former you don’t.
While the graphics certainly are under Apple’s copyright, and thus they are absolutely within their rights to demand their distribution stopped, it’s another matter whether this is in their best interest.

Anyways I never understood those OS X and Vista themes on S60. They look stupid on a Nokia phone.

Although I do agree with Andy C’s comment regarding copyright infringement, the whole ordeal seems to deal with timing.
People have been creating themes “paying homage” to Mac for years now. This isn’t a recent act, so why all of a sudden are the lawsuits generating?
The threat seems more hyped because Apple finally has a device out, but it I were one of the parties being sued I’d definately give them an earful!

From one point of view (juridicial) Apple may be right, from another (Public Relations) it is not quite positive for the image and “consumer-friendly” policy to start scandals, with the lawyers involved, BEFORE the official launch of the product. “Apple iSue” would be a convenient name for it…

ok…so I have the .rar file expanded to the “iphoneskinfiles” folder. what do I do to get this on my E61? Thanks in advance.
